Cabinet Member decisions during COVID-19 outbreak
Decisions are usually made by the Council’s Cabinet sitting as a whole however, due to the exceptional current circumstances caused by the Covid-19 virus, the Council used other powers in its Constitution (until emergency legislation was passed by Parliament) to allow decisions to be made by individual Cabinet members under powers granted to them rather than at meetings of the Cabinet.
Since members of the public are not currently able to attend meetings and speak about the decisions which are to be made, the Council is inviting them to write to tell us their views on the decisions which are being made. When making decisions during this period the Cabinet member concerned will take account of any written submissions sent before the deadline given.
The law divides all Council functions into Cabinet decisions and non-Cabinet decisions. The law also states that a Council's Cabinet Leader makes all the Cabinet decisions unless he or she decides that the Cabinet as a whole, individual Cabinet members or officers should do so. In practice the Council's Cabinet Leader decides that most of the important decisions are made by the Cabinet as a whole.
The law also states that certain Cabinet decisions are "Key Decisions" if they result in spending or saving of more than £250,000.00 or are likely to have significant effect on two or more wards in the borough.
Northampton Borough Council's Constitution states that only the Cabinet Leader or their deputy can make a Key Decision if the decision is not made by the Cabinet as a whole. The Constitution also allows the Cabinet Leader to make and vary a scheme of delegation saying which decisions are to be made by him and which are to be made by the Cabinet as a whole or individual Cabinet members, including Key Decisions.
Due to the coronavirus crisis the Council has suspended all face-to-face meetings to avoid risk of exposure for the public, Councillors and officers to the virus when attending meetings, until alternative arrangements can be made. The Cabinet Leader has determined that during that time he will make Key Decisions and other Cabinet members will make non-key decisions.
Before a decison is made copies of the Report which will be considered by each Cabinet Member will be published on the Council's website with copies of other relevant documents. These will appear at least 5 clear days (not including weekends or bank holidays) before the decision is taken.
A record of every decision made will appear on the Council's website as soon as practicable after it is made, usually the next working day.
